1. Who you are contracting with
Bowlful is operated by R R Hertel Enterprises (ABN 14 406 236 920) ("Bowlful", "we", "us", "our"), based in Australia. By using the website at bowlful.org and any related tools, calculators, downloads, or subscriptions (the "Service"), you enter into a binding agreement with R R Hertel Enterprises.
2. Acceptance of these terms
By accessing or continuing to use the Service you agree to these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your jurisdiction and, if acting on behalf of an organization, that you have authority to bind it.
3. The Service
The Service provides general pet-nutrition information, calorie estimates, feeding guidance, downloadable meal-plan PDFs, and curated product recommendations. The Service is informational only and is not veterinary advice. You should consult a licensed veterinarian before making changes to your pet's diet, especially for puppies, kittens, seniors, pregnant or nursing animals, or any animal with a medical condition.
4. Acceptable use
You agree not to: (a) use the Service unlawfully, fraudulently, or to spam others; (b) infringe anyone's intellectual property; (c) upload malware, probe, scan, or otherwise interfere with the security or integrity of the Service; (d) scrape, harvest, or republish our content at scale without written permission; (e) attempt to reverse-engineer, resell, or sublicense the Service; or (f) circumvent any technical limit, paywall, or access control.
5. Accounts and accuracy
You are responsible for any activity under your account and for keeping your credentials confidential. You agree to provide accurate information (including your pet's details) and to keep it current. Garbage in, garbage out — feeding calculations are only as good as the inputs you provide.
6. Intellectual property
All software, text, design, graphics, recipes, calculators, branding, and other content of the Service are owned by R R Hertel Enterprises or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial use within the plan you have selected. All other rights are reserved.
7. Paid plans, billing, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, taxes (including VAT/GST/sales tax), invoicing, renewal mechanics, and refund processing are governed by the Paddle Checkout Buyer Terms. Subscriptions renew automatically at the stated interval until you cancel. You can cancel at any time via the link in your Paddle receipt or at paddle.net; access continues through the end of the paid period.

9. User content
If you submit content (pet names, photos, feedback), you grant us a worldwide, royalty-free license to host and process it solely to provide and improve the Service. You represent that you have the rights to do so.
10. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that nutritional calculations will be suitable for any particular animal. Always confirm with a veterinarian.
10A. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to: cancel your service contract with us and obtain a refund of any unused portion; or compensation for the decrease in value of the services provided. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the service remedied in a reasonable time, and if this is not done, to cancel the contract and obtain a refund of the unused portion of the contract. Where our liability for breach of a consumer guarantee can lawfully be limited, our liability is limited (at our option) to supplying the services again or paying the cost of having the services supplied again.
11. Limitation of liability
To the fullest extent permitted by law, R R Hertel Enterprises' aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the fees you paid us in the twelve months preceding the claim or (b) USD $50. We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or harm to animals arising from reliance on general nutritional information. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.
12. Indemnity
You agree to indemnify and hold R R Hertel Enterprises harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.
13. Suspension and termination
We may suspend or terminate your access at any time for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends; previously downloaded PDFs remain yours to keep.
14. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use after changes means you accept them.
15. Governing law
These Terms are governed by the laws in force in Australia. The courts of Australia shall have non-exclusive jurisdiction over any disputes arising out of or in connection with these Terms or the Service, except where mandatory consumer-protection law (including the Australian Consumer Law for Australian customers) gives you the right to bring proceedings in another jurisdiction.
16. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control (e.g., outages of upstream providers, natural disasters, acts of government).
17. Assignment
You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
